Personal Data Protection Notice (KVKK) | SMC Logistics & ER-YILDIZ

1. Data Controller

Under Turkish Personal Data Protection Law No. 6698 ("KVKK"), your personal data is processed by SMC Logistics and ER-YILDIZ Customs Brokerage (the "Company") acting as data controller, within the scope described below.

2. Categories of Personal Data Processed

Depending on how you interact with our websites and communication channels, the following personal data may be processed:

If documents you upload contain personal data of third parties, you are deemed to confirm that the necessary information and legal basis for sharing such data has been ensured.

3. Purposes of Processing

Your personal data is processed for the purposes of:

Receiving, evaluating and responding to contact, quote and information requests,
Concluding and performing contracts for logistics, customs brokerage, warehousing and consultancy services,
Planning and executing operations and providing shipment status updates,
Creating, authorising and securing client portal accounts,
Fulfilling legal obligations, in particular under customs and foreign trade legislation,
Ensuring information security, monitoring systems and preventing misuse,
Sending newsletters and similar commercial electronic messages where you have given explicit consent,
Establishing, exercising and protecting legal rights and claims,
Evaluating job applications.

4. Legal Bases

Your personal data is processed on the following legal bases set out in Article 5 of the KVKK:

Conclusion or performance of a contract (Art. 5/2-c): data relating to quotes, operations and service processes,
Compliance with a legal obligation (Art. 5/2-ç): retention and reporting obligations under customs, tax, commercial and electronic communications legislation,
Establishment, exercise or protection of a right (Art. 5/2-e): records that may serve as evidence in potential disputes,
Legitimate interest (Art. 5/2-f): system security, log records and service quality improvement,
Explicit consent (Art. 5/1): newsletter subscription and non-essential cookie/analytics use not covered by the bases above.

5. Method of Collection

Your personal data is collected through fully or partly automated means via the forms on our websites (contact, quote, newsletter, portal login), e-mail and telephone communication, the WhatsApp redirection channel, and access records automatically generated by the web server.

6. Transfer of Personal Data

Limited to and proportionate with the purposes above, your personal data may be transferred to:

Carriers, agents and business partners to the extent required by the operation,
Customs authorities and, upon request, other authorised public institutions,
Suppliers providing hosting, e-mail and IT infrastructure services,
Legal and financial advisors,

in accordance with Article 8 of the KVKK. Where the nature of international transport operations requires transfers to agents and carriers abroad, such transfers are carried out in accordance with the mechanisms set out in Article 9 of the KVKK.

7. Retention Periods

Your personal data is retained for the period required by the processing purposes and the limitation/retention periods prescribed by applicable legislation; at the end of these periods it is deleted, destroyed or anonymised. Document retention obligations arising from customs and commercial legislation are reserved.

8. Your Rights (Article 11 of the KVKK)

Under Article 11 of the KVKK, everyone has the right to apply to the data controller and, with respect to their own data:

Learn whether their personal data is processed,
Request information if it has been processed,
Learn the purpose of processing and whether the data is used in line with that purpose,
Know the third parties to whom the data is transferred, in Türkiye or abroad,
Request correction of incomplete or inaccurate data,
Request deletion or destruction of the data under the conditions of Article 7 of the KVKK,
Request that corrections, deletions and destructions be notified to third parties to whom the data was transferred,
Object to a result arising against them from analysis carried out exclusively by automated systems,
Claim compensation for damages arising from unlawful processing.

9. How to Apply

You may submit requests regarding the rights above, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller:

In writing with a wet signature to "Eğitim Mah. Uğurelli Sk. No: 2/9, 34722 Kadıköy – Istanbul", or
From your e-mail address registered in our systems, to info@smclojistik.com.

Your application will be concluded free of charge as soon as possible and within 30 (thirty) days at the latest, depending on its nature; if the process requires an additional cost, the fee in the tariff determined by the Turkish Personal Data Protection Board may be charged.

10. Changes

The Company may update this notice in line with changes in legislation, technical infrastructure or business processes. The current version is always published on this page; the "Last Updated" date at the top is renewed for significant changes.
